Hi Everyone

 

Warrant Office Langeveld of Margate SAPS advised me that the case he opened is now in progress.  This means we can now close this petition.

 

In the meantime, if you still experience noise pollution from Level 101, feel free to report them as per my previous announcement.

 

Personally, my family have decided to move out of Margate CBD, mainly because of Level 101.  We used to be able to sleep well at night, to recover from the noise that the taxis made during the day.  But since Level 101 opened we can never tell if we will get a good night's sleep or not. We simply cannot live our lives this way.

PROGRESS UPDATE / ACTION REQUIRED - 16 JUNE 2023

Dear Petitioners

 

Thank you to everyone who has participated in this cause thus far. We are making progress!

Please note that "Level 10" or "Level 101" interchangeably. Both names refer to the same entity that we are petitioning about.

Here is the latest progress update and a list of the action steps I need from you to move this along as quickly as possible.

 

 

PROGRESS UPDATE:

 

1. A case has been opened

A case has been opened and Warrant Officer Langeveldt from the Margate Police Station (KZN) has taken statements from several complainants in Margate CBD; he took my statement on Tuesday 13th June 2023.

I sent him a list of the signatories of this petition list on the same day.

 He has also requested we continue to obtain petition signatures and, if possible, recordings of the noise pollution incidents with a record of the date and time of the noise, duration and location.

 

2. Collaboration with Level 10 / Level 101 Manager

The manager of Level 10 / Level 101 contacted me and requested assistance with getting details of the noise complaints. 

He said that he wants to do the following:

  1.  Organise a meeting in the next week with all complainants, so that he can hear everyone out and find out specifics and address them. 
  2. He would also like recordings to help him understand the problem.
  3. He advised me today that he is planning to work with the same sound technician that resolve the sound issue that Senzi's used to have. 

I'm willing to collaborate if this issue can be resolved.

After all, we simply want the noise and disruption of our sleep and peaceful home environments to stop. 

If the manager can find a solution that achieves our request, we can all get on with recovering from this challenge and continuing with our lives.

 

3. Faster Communication

I have opened a WhatsApp group (for our petitioners only) to make it easier for you to get notices of updates and to be able to collaborate. Those who have not signed this petition will not be allowed into our WhatsApp group.  The link is in the action steps below.

 

WHAT TO DO NEXT - IMPORTANT ACTION STEPS:

 

1. PLEASE get more petition signatures:

- Ask all your family members to sign this petition. Send them the link. If they need to use your device, you can clear the cache on your device first to ensure that you are logged out of the petition platform, so that they can sign up.

- Visit your neighbours in your area and ask them to sign the petition. Each person should try to get 3 others to sign the petition. If necessary, sit with them and assist them to sign the petition.

Ask for an Incident Report Number. (I/R Number).  

The constable taking your complaint will take down your information. Give them your name as per the petition, your phone number and address.

The constable might not be able to give it to you immediately, either due to load shedding or because they must wait for the van to return from the incident. You can call later to get it - you can even call them the next day.  

Come back to this announcement and enter the I/R number details in the comments section, OR you can enter it on the WhatsApp group.

However, if you are not in a position to call back later, then ask the constable for their name. Get the right spelling. Then, when posting the incident in the group or in the comments below, just mention the constables name, date and time you spoke to him/her.

 

4. PLEASE record noise incidents using the recorder on your phone. Be sure to speak during the recording, stating the date, time, location and your name. For example, on 16 June 2023 Level 10 / Level 101 woke me up at 1:05 am and they stopped around 4:00 am. I recorded a few minutes of the noise every 45 minutes or so, and during each recording I recorded myself giving the above information. Share the recordings in the WhatsApp group.

 

5. KEEP AN OPEN MIND. Let's do our best to resolve this.

 

After this is resolved, let's plan a bring and braai social (or similar) to celebrate somewhere in the South Coast!

CEASE OR MOVE!

My aim is to get Level 101 to cease and desist with breaking of our noise by-laws and invading our peace, and if that fails, to shut them down or forced to move elsewhere.

 

WILL YOU SUPPORT MY CAUSE?

 

I am personally fed up with sleepless nights on weekends and public holidays because of the constant noise from Level 101.

 

Anyone living in Margate, CBD would have to be deaf not to hear the incessantly loud music and microphoned voice coming from Level 101 most weekends, every month end and every public holiday weekend.

Level 101 is situated on Marine Drive, near the corner of Uplands Road and Marine Drive.

 

It seemed to me that from the month they moved in, they began ingoring the noise making by-laws.  And the effort began to try and get them to quieten down.

Despite many pleas to SAPS Margate Police and SAPS Traffic & Bylaws Protection Services, nothing has changed.

Level 101 continues to get progressively noisier and the most recent development is that their DJ is now using a microphone, yelling and singing so loudly we can't even concentrate, let alone think.

That area in Margate town is being flooded by their ridiculously loud noise. 

They sometimes give us relief by closing around 4am, but several times they continued later than that.

In my opinion, They are forcing us to listen to noise that we don't want to, and forcing us to have sleepless nights.

It is a well known fact that lack of sleep and lack of peace is detriment to our health and well being.

It can also negatively affect our work performance and home life.

The sickly and elderly are also being robbed of their rest and recuperation time. 

My husband is 79 years old this year, and can't sleep when Level 101 starts their nonsense.

For example, I can't even imagine the suffering of someone going through chemotherapy and needing rest, but being unable to due to the noise!

I'm half a block away and I can't sleep well when they start their noisemaking.

It horrifies me to think of what people are suffering who live directly opposite Level 101!

What about parents struggling to get their kids to sleep???

 

 

 

ENOUGH IS ENOUGH!!!!

The fact that the owners and managers of this business allow this illegal action to continue unabated - and the fact that SAPS seem to be unable to do anything about it means that we, as a community must take action.

Once before someone in our community took action, and a bottle store doing the same thing was shut down after a petition was gathered.

 

LET'S DO THE SAME THING!
