To judge something fairly you must first understand the motives of the accused, that will in turn show if the accused was prevoked. At this point you may be able to relate to the reaction as you ask yourself, "what would I have done in that situation?". On a side note, actions made when drunk should not be enfored on someone which is sober 99% of the time. We have all made mistakes while drinking, don't make a mistake to ban someone while you are sober.
